Section 8 Tenancy Termination Templates

Terminating a residential tenancy can be a complex and sensitive process, especially with the introduction of the Renters Rights Bill.  Under the Bill Section 21 "no fault" evictions are abolished, meaning landlords will need to rely on specific legal grounds under Section 8 to end the tenancy. 

Landlords in England must now ensure they follow the correct legal procedures before seeking possession of their property.  For Welsh landlords please refer to Renting Homes Wales.

A Landlord can only evict a residential Tenant if he has obtained a court order for possession. A court will not grant an order for possession unless it is satisfied that the Landlord has followed the correct procedures and served the proper Notices on the Tenant.

Obtaining Possession under Section 8 Housing Act 1988 is a useful Guidance note providing an overview on the current mandatory and discretionary grounds.
